1. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. Listings and Trades

TradeM8 is a platform that allows users to offer, search for, and engage in barter transactions for services and physical products.

• User Responsibility: You are solely responsible for the accuracy, legality, and content of your listings, including descriptions, images, and claimed value. You must own or have the right to trade any items or services you list.
• Prohibited Items/Services: You may not list illegal items/services, items/services that infringe on intellectual property rights, or any other items/services deemed inappropriate by us in our Community Guidelines or at our discretion.
• Trade Agreements: When users agree to a trade, they are entering into a direct agreement with each other. TradeM8 is not a party to any trade agreement. The "Confirm Trade" feature or similar in-app confirmation signifies an agreement between users.
• Valuation: Users are responsible for determining the value of items/services and negotiating trades. Values listed are estimates and not guaranteed by TradeM8.
• Quality and Condition: TradeM8 primarily encourages the trade of new products or high-quality services. Users are expected to accurately represent the condition of items.

3. User Conduct and Community Guidelines

You agree not to use the Service to:

• Violate any laws or regulations.
• Post false, misleading, or defamatory content.
• Harass, abuse, or harm another person.
• Infringe upon the rights of others, including intellectual property rights.
• Distribute spam or unsolicited commercial messages.
• Interfere with or disrupt the Service.

We reserve the right to remove content and terminate accounts for violations of these Terms or our Community Guidelines.

4. Intellectual Property

5. Disclaimers and Limitation of Liability

Platform Only: TradeM8 is a platform provider and is not involved in the actual transactions or interactions between users. We do not vet users, guarantee the quality, safety, or legality of items/services traded, or the truth or accuracy of listings.

No Warranty: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, expressed or implied, regarding the Service.

Limitation of Liability: To the fullest extent permitted by applicable law, TradeM8 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.

6. Dispute Resolution (User-to-User)

Users are encouraged to resolve disputes directly. TradeM8 may provide tools or guidelines to assist in dispute resolution but is not obligated to mediate or resolve disputes between users. You can report issues with listings or users through the flag/report feature.

7. Tax Implications

You acknowledge and agree that bartering transactions may have tax implications under Australian law, including GST and income tax. You are solely responsible for understanding and complying with your tax obligations. TradeM8 is not responsible for advising on tax matters. 8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
